Official Sweepstakes Rules & Award Rules

1. ELIGIBILITY. No purchase necessary to enter or win. Purchasing does not increase your chances of winning. This Smockadot Kids Facebook Sweepstakes ("Sweepstakes"), sponsored by Smockadot Kids LLC ("Sponsor"), is governed by these rules (the “Official Rules”). This Sweepstakes is open to residents of the United States who are eighteen (18) years of age or older at the time of entry (the “Entrant”). Entrants who are not residents of the United States AND/OR Entrants that are not eighteen (18) years of age or older are not eligible to win a prize. Eligible entries must be completed and received by the Sponsor in the format designated below. Employees, officers, or directors of the Sponsor, its parent companies, affiliates, subsidiaries, advertising and promotional agencies, and their children, parents, spouse, and members of their household are ineligible to participate. All applicable federal, state, and local laws and regulations apply. Offer void where prohibited.

2. SWEEPSTAKES PERIOD. The Sweepstakes shall commence on February 18, 2012 at or around 12:01 AM Eastern Standard Time ("EST") and end when the Sponsor has reached 200,000 fans on the corresponding Facebook Page ("Sweepstakes Period").

3. HOW TO ENTER. To enter, complete the entry form located on our Facebook Sweepstakes Tab. Fill in all required information including first name, last name, state, e-mail address, sizes and genders of children for which the Entrant shops. Complete entries must be submitted in accordance with instructions during the Sweepstakes Period. All entries will become property of the Sponsor and will not be returned. Limit one entry per person. In the event of any dispute, entries will be deemed to have been submitted by the owner of the e-mail address submitted. False or deceptive entries or acts will render the Entrant ineligible.

4. PRIVACY. The information collected to enter the Sweepstakes will be used to contact the Entrant in the event that the Entrant is chosen to receive a prize. Additionally, the Sponsor will use this information for marketing purposes, but will not share or sell any information to third parties. As stated above, the Sweepstakes is not open to Minors under the age of eighteen (18). In the event that an Entrant is under the age of eighteen (18) years and submits an entry to the Sponsor, the Sponsor will delete, erase or destroy any and all personally identifiable information that is obtained from the entry.

5. DISCLAIMER. The Sponsor, all participating sponsors and any of their respective affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for:

(a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries;

(b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures;

(d) any printing or typographical errors in any materials associated with the Sweepstakes.

6. PRIZES. Prizes for the sweepstakes consist of new, unworn merchandise. These items will be chosen by the Sponsor and include personalization according to the winner’s specifications, where applicable. Personalization must be indicated exactly as the winner wishes it to appear. Prizes are as follows:

(a) Daily prizes consisting of 1 item per day valued at $15.00 or more (odds of winning are 1:200,000 per day)

(b) 4 fan-based prize packages (prizes drawn when the Facebook fan base reaches a certain level, dictated by the number of individual “Likes” the page receives):

(i) At 125,000 fans, 1 prize package valued at $100 for ONE winner (odds of winning are 1:125,000)

(ii) At 150,000 fans, 1 prize package valued at $200.00 for ONE winner(odds of winning are 1:150,000)

(iii) At 175,000 fans, 1 prize package valued at $300.00 for ONE winner(odds of winning are 1:175,000)

(iv) At 200,000 fans, 1 prize package valued at $500.00 for ONE winner(odds of winning are 1:200,000)

All prizes will be awarded. Prizes returned as undeliverable or otherwise not claimed within three (3) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). All federal, state, and local taxes associated with the receipt or use of any prizes are the sole responsibility of the winner.

7. ODDS OF WINNING. The odds of winning are stated after each prize (see Paragraph 6 above).

8. SELECTION OF WINNERS. Winners will be determined by random drawing from all eligible entries received. Daily drawings will be held on the Friday of that given week, with one winner for the previous Friday through Thursday. (For example, for the dates of February 18, 2012 through February 23, 2012, one winner for each day will be chosen on February 24, 2012.) Fan-based drawings will be held the day immediately following the reaching of that specific goal. (For example, if the fan count on the corresponding Facebook page reaches 125,000 by February 28, 2012, the winner of that fan-based prize package will be drawn on March 1, 2012.)

9. NOTIFICATION OF WINNERS. Sweepstakes winners will be notified by email within 24 hours of the drawing. All decisions are final and binding. Winners must respond via email to claim their prize, within three (3) calendar days from the date the notification is sent by the Sponsor. Response must include necessary information to redeem the prize, such as personalization information and shipping address. Failure to contact the Sponsor within that three (3) day period will result in immediate disqualification of the selected Entrant and a new winner will be selected. Should the notification email be returned to the Sponsor as invalid, the Entrant will be immediately disqualified and a new winner will be selected. No exceptions will be made to this rule. The Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners.

10. GENERAL RELEASE. By entering the Sweepstakes, you release the Sponsor, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, attorney’s fees, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

11. AFFIDAVIT & RELEASE. As a condition of being awarded any prize, winners may be required to execute and deliver to the Sponsor a signed Affidavit of Eligibility, which includes an acceptance of these Official Rules and a release of liability.

12. FACEBOOK RELEASE. By entering the Sweepstakes, all Entrants and participants release Facebook of any and all liability, acknowledging that this Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook. All information provided by each Entrant through this Sweepstakes is provided to the Sponsor and not to Facebook.

13. WINNERS LIST. Copies of the current winners list will be available to all Entrants upon request after March 1, 2012 and before the close of the Sweepstakes. A final winners list may be requested immediately following and within three months of the close of the Sweepstakes. Entrants who wish to receive a copy must submit a self-addressed stamped envelope to the Sponsor at the following address:

14. RULES REQUEST. Entrants who wish to obtain a printed copy of these rules must send a self-addressed stamped envelope to the Sponsor at the following address:

16. CHOICE OF LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and the Sponsor in connection with the Sweepstakes, will be governed by, and construed in accordance with, the substantive laws of the State of South Carolina and the United States. Entrants agree to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects. The Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Sweepstakes or any entrant's participation in the Sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond the Sponsor's control affect the administration, security or proper play of the Sweepstakes or the Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned. Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to the Sponsor, the Sweepstakes or any other Entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Sweepstakes. The Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes.

17. SWEEPSTAKES SPONSOR. The Sponsor of the Sweepstakes is Smockadot Kids LLC.
